Welcome to Ginomeds. These Terms and Conditions (“Terms”) apply to your use of ginomeds.com (the “Website”) and to all purchases made on it. Please read them carefully. By using the Website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Refund and Return Policy, Cancellation Policy and Medical Disclaimer. If you do not agree, please do not use the Website.

2. Eligibility

You must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872 to place an order. If you are under 18, you may use the Website only with the involvement of a parent or guardian.

3. Your account

You are responsible for keeping your account password confidential and for all activity under your account. Please give accurate, complete and up-to-date information. Tell us immediately if you suspect any unauthorised use of your account. We may suspend or close accounts that are used fraudulently or in breach of these Terms.

4. Products and product information

  • We make every effort to show accurate product names, ingredients, pack sizes, prices and images. Images are for illustration; the actual packaging may vary slightly.
  • The details printed on the product label – including ingredients, directions, warnings, batch number, manufacturing date and expiry date – take priority over the information on the Website.
  • As required by law, product pages show key details such as the name of the manufacturer or marketer, country of origin, and the total price including taxes.
  • Product information on the Website is for general information only and is not medical advice. Please read our Medical Disclaimer.

5. Prices

  • All prices are shown in Indian Rupees (₹) and are inclusive of GST. Shipping charges, if any, are shown separately at checkout before you pay.
  • No product will be sold above its Maximum Retail Price (MRP).
  • Prices and offers may change without notice. The price that applies is the price shown at the time you place your order.
  • If a product is listed at an incorrect price because of an obvious error, we will contact you before dispatch. You may choose to buy at the correct price or cancel the order for a full refund.

6. Orders

  • Your order is an offer to buy. We will send an order confirmation by email and SMS. A contract is formed when your order is dispatched.
  • We may decline or cancel an order – for example, if the product is out of stock, the delivery address is not serviceable, there is a pricing error, or we suspect fraud. If this happens, we will inform you and refund any amount paid in full.
  • We may limit the quantity of any product per order or per customer.
  • We do not charge any cancellation fee for orders cancelled in line with our Cancellation Policy.

7. Payment

We accept UPI, debit/credit cards, net banking and popular wallets through our payment gateway, Razorpay. Cash on Delivery (COD) is available on orders up to ₹5,000 with no extra fee. Payments are subject to the terms of the payment gateway and your bank. We do not store your full card details, CVV, UPI PIN or net banking password.

8. Shipping and delivery

Delivery timelines and charges are explained in our Shipping Policy. Risk in the products passes to you on delivery. Delivery timelines are estimates, and delays can happen for reasons outside our control.

9. Returns, refunds and cancellations

Returns, refunds and cancellations are governed by our Refund and Return Policy and Cancellation Policy, which form part of these Terms. For hygiene and safety reasons, opened or used health products are generally not returnable.

10. Acceptable use

When using the Website, you agree not to:

  • give false information, impersonate anyone or use someone else’s payment details without permission;
  • buy products for resale without our written consent;
  • post content that is unlawful, abusive, misleading or that infringes anyone’s rights;
  • try to hack, disrupt or overload the Website, or use bots or scrapers to collect data; or
  • use the Website for any purpose that breaks any law in force in India.

11. Reviews and content you submit

You may post reviews and ratings about products you have bought. Reviews must be honest and based on your own experience, and must not contain medical claims, offensive language or personal data of others. We may remove reviews that break these rules. By posting a review, you allow us to display it on the Website.

12. Intellectual property

All content on the Website, including text, graphics, logos, images and software, belongs to Ginomeds or its licensors and is protected by Indian intellectual property laws. Ginova Wellness is our own brand. Brand names and trademarks of products from other companies belong to their respective owners. You may not copy, reproduce or use any content without our written permission.

13. Limitation of liability

  • To the maximum extent permitted by law, Ginomeds will not be liable for any indirect, incidental or consequential loss arising from your use of the Website or the products.
  • Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
  • We are not responsible for any harm arising from use of a product against the label directions, medical advice or these Terms.
  • Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 or any other law that cannot be excluded.

14. Indemnity

You agree to indemnify Ginomeds against any claims, losses or expenses arising from your breach of these Terms or misuse of the Website.

15. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, such as natural disasters, floods, pandemics, strikes, government orders, transport disruptions or technical failures.

16. Grievance Officer

You can raise a complaint by email, or by post to the address above. Please include your order number and a short description of the issue. We will acknowledge your complaint within 48 hours of receiving it and resolve it within one month from the date of receipt. We will keep you informed of the progress.

If you are not satisfied with the resolution, you may contact the National Consumer Helpline (toll-free 1915, or consumerhelpline.gov.in) or approach the appropriate Consumer Commission under the Consumer Protection Act, 2019.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to your rights as a consumer to approach a Consumer Commission under the Consumer Protection Act, 2019, the courts at Chennai, Tamil Nadu, will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Website.

18. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with the “Last updated” date. Orders already placed will be governed by the Terms in force at the time of the order.

19. General

If any part of these Terms is found to be invalid, the rest will remain in effect. Our failure to enforce any right does not mean we have waived it. These Terms, together with the policies referred to above, form the entire agreement between you and Ginomeds regarding use of the Website.
